Set Point Volleyball — Website and Mobile Application

By accessing or using the Set Point Volleyball website (www.setpointvolleyball.com), the Set Point mobile application, or any related features, tools, or content (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Notice, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.
If you are under the age of 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the Service.
Set Point Volleyball ("Set Point," "we," "us," or "our") is a volleyball-specific recruiting and college readiness platform that connects student-athletes, their families, college coaches, and club directors. Features of the Service include, but are not limited to:
We may update, modify, add, or remove features from time to time to improve performance, security, or compliance, or to reflect changes in NCAA rules or regulations. We will endeavor to provide reasonable notice of material changes.
Set Point is not affiliated with, endorsed by, or sponsored by the National Collegiate Athletic Association (NCAA).
To access certain features of the Service, you must create an account. When registering, you agree to:
You may not share your account credentials with any third party or use another person's account without permission. We reserve the right to suspend or terminate accounts that contain false or misleading information.
Athletes and their parents or guardians may create profiles showcasing athletic and academic information for the purpose of college recruiting. You are responsible for the accuracy of all profile content and for ensuring that any content you submit (including videos, photos, references, and test scores) does not infringe on the rights of others.
College coaching staff may create free accounts to search athlete profiles, use watchlist tools, and communicate with prospective recruits. Coach accounts are subject to NCAA-compliant messaging restrictions. By using Set Point, coaches represent that their use of the Service complies with all applicable NCAA, NAIA, NJCAA, and institutional rules governing recruiting.
Club directors, team coaches and administrators may access dashboards to manage athlete rosters and track recruiting outcomes. Club accounts may have access to individual athlete profile data only to the extent athletes or families have granted such access.
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You will not:
You retain ownership of any content you submit to the Service, including profile information, game film, photos, academic records, and messages ("User Content"). By submitting User Content, you grant Set Point a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and use your User Content solely to operate, maintain, and improve the Service and to facilitate recruiting workflows for which the Service is designed.
You represent and warrant that: (a) you own or have the necessary rights to all User Content you submit; (b) your User Content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) your User Content complies with these Terms and applicable law.
We reserve the right, but not the obligation, to remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
The Service includes AI-powered features, including match scoring, email drafting assistance ("AI Email Coach"), and college and career readiness insights. These features are provided as tools to assist and inform your decisions — they are for entertainment and informational purposes only and not guarantees of recruiting outcomes, college admission, scholarship awards, or NCAA eligibility.
AI-generated content should be reviewed and verified by you before use. We make no representations that AI-generated outreach emails, college match recommendations, or eligibility assessments are free from error, which may include hallucinations or other inaccuracies. You are solely responsible for any communications you send using the Service.
Set Point is designed to support NCAA-compliant recruiting activity. However, it is the sole responsibility of each user, including student-athletes, their families, coaches, and club directors, to ensure their use of the Service complies with applicable NCAA, NAIA, NJCAA, and institutional rules. Set Point does not provide legal or compliance advice and makes no representations that use of the Service ensures compliance with any governing body's regulations.
Set Point offers both a free tier and a paid "Pro" subscription. Paid subscriptions are billed on a monthly or annual basis as selected at the time of purchase. The following terms apply to paid subscriptions:
College coaches receive free access to the Service and will never be charged to search, contact, or recruit athletes through Set Point.
The Service, including its software, AI models, databases, algorithms, branding, logos, design elements, and content created by Set Point (collectively, "Set Point IP"), is owned by Set Point Volleyball and its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
Except for the limited right to use the Service as expressly granted under these Terms, no rights in the Set Point IP are transferred to you. You agree not to copy, modify, distribute, reverse engineer, decompile, disassemble, or create derivative works based on any Set Point IP.
Your use of the Service is subject to our Privacy Notice, available at www.setpointvolleyball.com/privacy, which is incorporated into these Terms by reference. The Privacy Notice describes how we collect, use, and share information about you, including special considerations for users under 18.
The Service may integrate with, or contain links to, third-party websites, platforms, and services (e.g., video hosting, payment processors, social media). These third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for the content, privacy practices, or availability of third-party services, and your use of them is at your own risk.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SET POINT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SET POINT DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS WILL BE CORRECTED; (C) THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) COLLEGE MATCHING, ELIGIBILITY, OR FINANCIAL AID ESTIMATES WILL BE ACCURATE OR RESULT IN ANY PARTICULAR RECRUITING OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SET POINT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL SET POINT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO SET POINT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Set Point, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or third-party rights; or (e) your violation of any NCAA, NAIA, NJCAA, or institutional rule.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have: (a) violated these Terms; (b) used the Service in a way that may cause harm to others or to Set Point; (c) provided false or misleading information; or (d) engaged in conduct that is fraudulent or otherwise objectionable.
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 10, 13, 14, 15, and 18) shall survive.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document and, where appropriate, provide notice through the Service or by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction in such courts.
PLEASE READ THIS SECTION CAREFULLY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SET POINT AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, EXCEPT THAT EITHER PARTY MAY SEEK INJUNCTIVE RELIEF IN COURT FOR INTELLECTUAL PROPERTY OR DATA SECURITY MATTERS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at [email protected].
For users between 13 and 17 years of age, we require that a parent or legal guardian review and consent to these Terms and to our Privacy Notice before the minor uses the Service. Athletes under 18 should use the Service only with parental awareness and involvement, including use of the family dashboard feature.
