For users in jurisdictions where a legal basis for processing is required, we process personal information on the following bases:

  • Contract performance: Processing necessary to provide you with the Service you have requested
  • Legitimate interests: Analytics, fraud prevention, security, service improvement, and marketing to existing users (subject to your right to opt out)
  • Legal obligation: Processing required by applicable law
  • Consent: Where we request your consent (e.g., marketing emails, push notifications, or sensitive data processing), we rely on that consent, which you may withdraw at any time

4. How We Share Your Information

Set Point does not sell your personal information under any circumstances. We also do not use your data to train AI models or for purposes unrelated to providing the Service.

4.1 With College Coaches (Athlete Profiles)

If you are an athlete, your profile — including name, graduation year, position, academic information, game film, and recruiting preferences — is visible to college coaches who use the Service. This sharing is the core purpose of the platform and is consented to when you create a profile. You may control profile visibility in your account settings.

4.2 With Club Directors

If a club or team director adds you to a club roster within the platform, that director may have access to your profile completion status and certain recruiting metrics as displayed in the club dashboard. The club director will not have access to private messages or payment information.

4.3 With Service Providers

We share information with third-party vendors who help us operate the Service, including cloud hosting and data storage providers, payment processors, email delivery and communication platforms, analytics providers (e.g., Google Analytics), and customer support tools. These vendors are contractually prohibited from using your information for any purpose other than providing services to us.

4.4 With Advertising and Analytics Partners

We may share limited identifiers (e.g., IP address, device ID, browsing behavior) with marketing and analytics vendors to measure the effectiveness of our advertising and to deliver relevant promotional content. This may constitute "sharing" under California law or other applicable law. You may opt out via our cookie banner or browser privacy controls, or by emailing [email protected].

4.5 For Legal and Safety Reasons

We may disclose your information to law enforcement, courts, regulators, or other third parties when required by applicable law, legal process, or to protect the rights, property, or safety of Set Point, our users, or others.

4.6 Business Transfers

If Set Point is acquired, merged with, or sells all or substantially all of its assets to another entity, your information may be transferred as part of that transaction. We will provide notice before such a transfer takes effect if required by applicable law.

5. Special Considerations for Minor Athletes

Set Point serves student-athletes, many of whom are under 18 years of age. We take the following steps to protect the privacy of minors:

  • We do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13 without verifiable parental consent, we will delete that information promptly.
  • For users between 13 and 17, we strongly encourage parental use of the family dashboard to monitor the athlete's profile and recruiting activity.
  • We do not use athlete profile data for targeted advertising or behavioral profiling that is unrelated to recruiting.
  • Athlete profiles are only visible to verified college coaches and club directors with legitimate access to the Service.

If you believe we have collected personal information from a child under 13, please contact us immediately at [email protected].

5A. Family Dashboard and Granular Sharing Controls

Parents and guardians of minor athletes (under 18) have full visibility and control through the family dashboard. This includes granular sharing controls (share_college_list, share_gpa_detail, share_video, and similar toggles) that allow parents to control exactly which data is visible in the athlete's public recruiting profile, real-time monitoring of recruiting communications and college coach interactions, and control over AI feature usage (e.g., whether the athlete can use AI Email Coach).

Your child's athletic career isn't a dataset. Set Point does not sell minor athlete data, does not use it to train AI models, and does not combine it with data from other services for behavioral profiling or targeting.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Service, remember your preferences, and analyze usage. Types of cookies we use include:

  • Essential cookies: Required for the Service to function (e.g., keeping you logged in). These cannot be disabled.
  • Analytics cookies: Help us understand how users interact with the Service (e.g., Google Analytics).
  • Marketing cookies: Used to deliver relevant advertisements and measure campaign effectiveness.

You can manage cookie preferences via our cookie banner, your browser settings, or the opt-out tools listed below:

  • Google Analytics opt-out: https://tools.google.com/dlpage/gaoptout
  • Network Advertising Initiative opt-out: https://optout.networkadvertising.org
  • Global Privacy Control (GPC): Honored where required by applicable state law

Note: We do not honor "Do Not Track" browser signals, as there is no industry-wide standard for these signals.

7. AI-Powered Processing

Set Point uses artificial intelligence and machine learning to power features including college match scoring, the AI Email Coach, and college readiness insights. This processing involves:

  • Analyzing your athletic profile, academic data, and preferences against NCAA roster and program data (college matching runs entirely on Set Point servers with no external AI)
  • Generating personalized outreach email drafts based on your inputs and selected programs
  • Scoring and ranking college program fit based on factors including position need, academic alignment, and geography

7A. AI Data Privacy and the Privacy Proxy

Set Point implements a privacy-first architecture for all AI-powered features. Before any data reaches an AI API, it passes through our privacy proxy that automatically strips all personally identifiable information.

Data Sent to AI: Position, graduation year, academic tier (not exact GPA), region (not city/state), and roster context.

Data NEVER Sent to AI: Name, school, email, phone, exact GPA, test scores, video URLs, or any contact information.

We use Anthropic as our AI provider. Anthropic's API terms contractually prohibit using your inputs or outputs for model training.

7B. Consent Architecture for AI Features

Set Point implements a tiered consent architecture. Necessary services (Clerk authentication, Stripe payments, and Sentry error tracking) do not require separate consent. Functional AI features require explicit opt-in per feature (e.g., Email Coach, Reference Drafting). Analytics are opt-in via settings and off by default.

Users can grant or revoke AI feature consent at any time from privacy settings. Consent records are stored in our database with timestamps. Set Point honors Global Privacy Control (GPC) signals in accordance with applicable law — when GPC is detected, analytics consent defaults to off and no banner is shown.

7C. Partner Data Commitments

All third-party partners used by Set Point — including Anthropic (AI), Clerk (authentication), Stripe (payments), and SendGrid (email) — were contractually required to agree to Set Point's data protection standards. These agreements include explicit prohibitions against selling user data, training machine learning models on user data, or using user data for any purpose beyond providing their specific service.

AI-generated outputs are tools to support your decision-making and are not binding recommendations or predictions. You remain responsible for reviewing and approving all communications you send through the Service. We do not use your personal information for automated decision-making that produces legal or similarly significant effects without human review.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including:

  • Active accounts: As long as your account remains active
  • Subscription and payment records: As required by tax and financial record-keeping laws (typically 7 years)
  • Communications and support records: Up to 3 years after account closure
  • Analytics and usage data: Up to 2 years in identifiable form

When you delete your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law or to resolve open disputes.

9. Data Security

We implement industry-standard administrative, technical, and physical security measures to protect your personal information from unauthorized access, loss, destruction, or alteration. These measures include encryption in transit (TLS) and at rest, access controls, and regular security assessments.

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach affecting your rights, we will notify you as required by applicable law.

9A. IP Address Handling

IP addresses are never stored in raw form. When IP addresses are retained for legitimate security and audit purposes (e.g., consent audit logs), only salted SHA-256 hashes of the IP address are stored. Raw IP addresses are discarded immediately after hashing and are never persisted in our systems.

10. Your Privacy Rights
